ServedUp Brand Promotions Terms & Conditions

The Venue - Each individual business that uses the ServedUp platform to accept orders

The Offer [offers] - Refers to any brand promotion displayed on the ServedUp dashboard within the “offers” section

The Brand [brands] - The companies which provide offers visible on BrandUp.

Activation - The activity which has been indicated by the brand that qualifies The Venue for receiving a Reward(s), in most cases, this is menu sponsorship.

Menu Sponsorship - The process of The Brand highlighting their product on The Venue menu.

ServedUp - A technology software product enabling ordering within The Venue

BrandUp - The name of the feature that provides brand offers. 

Reward(s) - The compensation for accepting and activating The Offer.

Offer conditions - Information displayed within each of the offers on the ServedUp dashboard which details the requirements, restrictions, and obligations The Venue must satisfy in order to receive Reward(s)

The Promoter - Innovate Energy Solutions Ltd. (t/a theUp.co / ServedUp)

 

  1. BrandUp is open to users of the ServedUp platform in the United Kingdom that are aged 18 and over, with the exception of Innovate Energy Solutions Ltd. (t/a theUp.co) employees and contractors, their immediate families and anyone professionally associated with BrandUp.

  2. BrandUp overview - to receive brand offers, The Venue must follow these steps

    1. Navigate to the “offers” section of the ServedUp dashboard

    2. Read the offer conditions and if eligible press “accept” 

    3. Complete any additional steps detailed on the offer 

  3. Eligibility: the additional criteria below must be met in order for any reward from any offer to be administered. All criteria items listed below must be met without any exceptions:

  4. The Venue must be signed up to, and use, the ServedUp platform.

  5. The Venue acknowledges and agrees that, as between the Venue and the Promoter, the Venue shall have sole responsibility and liability for compliance with any and all laws, rules and regulations applicable to making the Offer available to consumers at the Venue, including but not limited to licensing laws relating to the sale and consumption of alcohol. The Venue shall indemnify and hold harmless the Promoter against any and all claims relating thereto.

  6. The Venue agrees to the conditions of each offer and agrees to comply with the offer conditions for the entire duration of the offer as detailed on the ServedUp dashboard.

  7. The Venue must stock and sell the product(s) detailed in each unique offer throughout the duration of the activation period.

  8. Additional rules: in addition to the criteria in point 3, the rules below apply to BrandUp offers for a reward(s) to be valid. No exceptions will be made: 

      1. The Venue agrees to not tamper with any sponsored menu items without the prior consent of ServedUp.

      2. If The Venue is out of stock of the product detailed in each offer for longer than 50% of the activation period, they will not be eligible for any rewards associated with the offer.

      3. The Venue must have had at least 100 orders of any product in the 7 days preceding the offer redemption and 400 orders of any product following the offer redemption in order to be eligible for any rewards associated with the offer.

  9. Some offers cannot be redeemed in conjunction with others, if this is the case, it will be highlighted within the offer conditions on the relevant offers.

  10. Should The Venue accept multiple offers which cannot be redeemed simultaneously, ServedUp will honour the first offer redeemed by the venue and cancel any other offers redeemed by the venue.

  11. ServedUp reserves the right to cancel or reject any venue activation should the venue not meet the conditions set out in the unique offer conditions, and the BrandUp terms and conditions.

  12. ServedUp will communicate with the venue on activation progress including but not limited to: cancelling activations, beginning activations, and ending activations.

  13. ServedUp reserves the right to decide when the venue’s activation will go live. Usually, this will be within 48/24 hours of the venue redeeming the activation. If an offer is redeemed during the weekend, this will typically be activated by ServedUp the following Monday.

  14. If the venue is eligible and has satisfied the criteria of the offer the reward will be paid to the venue within 31 days, unless otherwise stated in the specific offer criteria, following the offer ending if the venue has complied and satisfied the criteria detailed in the offer conditions.

  15. Accepting any given brand offer does not guarantee The Venue that the activation will go live, any rewards associated with the offer will be dependent on The Venue having the offer live for the time shown in the offer conditions.

  16. If The Venue wishes to begin stocking products in order to access ServedUp offers, The Venue can re-apply for offers they were not previously eligible for.

  17. The Venue has automatic access to ServedUp offers, however brand partners featured on the ServedUp dashboard reserve the right to impose their own designated terms and conditions found on each unique offer which may exclude a non-eligible venue.

  18. No responsibility can be accepted by ServedUp for The Venue not being eligible for offers for whatever reason.

  19. By accepting an offer and this going live in your venue, you agree to allow ServedUp and third party partner brands to directly contact end users participating in offers.

  20. The Promoter will not be liable for any failure to comply with its obligations or any delay in performing its obligations within these terms and conditions If an act, omission, event or circumstance occurs caused by (but not limited to) global or regional health crises, weather conditions, fire, flood, strike, hurricane, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, epidemic, pandemic, famine, plague or other natural calamities and acts of God, or any other circumstances beyond the reasonable control of the Promoter.

  21. An offer reward will only be made directly to individual participating venues in BrandUp offers. Bulk participation in BrandUp offers from trade, consumer groups or third parties will not be accepted. Incomplete or illegible offers and rewards by macros or other automated means which do not satisfy the requirements of these Terms & Conditions in full will be disqualified and will not be counted. If it becomes apparent that a venue is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to increase that venues participation in BrandUp offers in a way that is not consistent with the rules of BrandUp offers then that venues participation will be disqualified and any rewards will be void. Venues are not permitted to enter using anonymous email services such as, but not limited to, GuerillaMail, Dispostable or Mailinator.

  22. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate venues or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up this promotion except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected

  23. The Promoter may refuse to award your reward(s) in the event of any venues fraud, dishonesty, breach or non-entitlement under these Terms & Conditions or seek recovery of its value if the reward(s) has been awarded.

  24. If for any reason a technical interruption, fault or site failure occurs during an activation, the Promoter does not take any responsibility for incomplete activations and any incomplete activations will not be considered valid. The Promoter accepts no responsibility for any activations which are not completed for any reason.

  25. By accepting an offer or registering your venue with BrandUp you allow ServedUp to share your details with the particular brand and third parties related to that offer.
